After nine months' maternity leave I returned back to the same place of employment. I requested to come back part time (one less day per week). It was refused on the basis that the role required I be at work 5 days per week. They offered me another job role that I could do 4 days a week, which I accepted. However, this other job (that I am still doing) was offered to me with a lower salary (as well as being pro rata). I wasn't sure if they were supposed to give me the same terms & conditions as before I left for maternity leave, and if this is supposed to include 'same salary' also? I had a car allowance and understood that this was not part of the new job, so naturally this was removed, but they also lowered my salary in line with the lesser role (as the new job title did not pay as well)... Is this allowed?
My employer has turned down my request to work 4 days a week when I return to work after maternity leave (SMP) which I am currently on. I usually work 5 days a week and my request was made due to the fact that the child minder I have found only has a 4 day a week slot available and I am reluctant to let this go as we have had trouble finding a good local child minder and the lady we have found is rated as outstanding by Ofsted. There are 2 secretaries where I work (me being one of them) and my request was made on the basis that the other secretary would be able to cover me for one day. My request has been turned down because it turns out my employer decided not to replace the other secretary who left the company just before I went on maternity leave, and instead have just one secretary i.e. me. I was never informed of this so it was complete news to me and a bit of a shock when my boss turned down my request on the basis that they required full time secretarial support. In the 4 years I have worked at the company they have always employed 2 secretaries and it does concern me that the workload will fall just on me. I voiced my concerns to my boss in a telephone conversation but was simply told that the girl who was covering my maternity leave is managing so he didn't see why I couldn't. My boss' manner was quite blunt on the phone, and not friendly in any way. I felt extremely anxious after the conversation and have been feeling very low ever since. When my boss replied to my original email request he ruled out the option of us getting a temp to cover me each Wednesday on the basis of workflow continuity. The whole situation is really playing on my mind. My job has changed without any word or warning to me and because of this my 4 day a week request has been denied. FYI I made 2 other requests which were granted; the first that I extend my maternity leave, and the second request was that I have half an hour lunch break instead of an hour and leave the office half an hour earlier each evening.
I have just returned to work following 39 weeks maternity leave. Nine months to going on maternity leave I underwent a consultation process to broaden the remit of my role. I received no pay increase, but my job title was changed and my team's name (and remit) was changed. One of my team acted up into my role whilst I was on maternity leave, but as she didn't have relevant experience was given only my original remit and not the broader role, the team was also refocused to the original remit. I was told I would return to the role that I left with the broader remit, but now that I'm back my boss keeps referring to me and my team as per my maternity cover. Effectively it looks like I've got a reduction in responsibility and potentially status as a result of going on maternity leave. My job title seems to have reverted to pre consultation. There's been no change to my pay.
I am currently on maternity leave and have been working the same hours days and times for six years. We have recently been tupe'd so the new company are paying my maternity pay. i recently told them I was returning in September and found out they had employed six new members of staff and when I asked about my hours etc they said I'm on a zero hours contract so am not enitiled to my days, time etc back and that they will be shared out with new employees starting the same time. Can they do this? They have agreed as a good will gesture to pay me holiday pay for the hours I would have worked if i was still currently working. I have had a phone call today to ask me to attend a meeting as they are now changing my contract from zero hours (term time only) to zero hours 52 weeks a year and have said that if I don't sign my new contract I will not get any hours whatsoever! This is distressing me as I have 3 young children and need to work, but will now not have the school holidays off. I want to know where I stand with this all. Maternity leave is supposed to be relaxing bonding with your baby, but all I seem to have to deal with is a load of stress from my new employers.
I'm currently appealing a grievance decision by my company not to return me to my previous role following 12 months maternity leave. The reasons were that they thought my maternity cover was a better qualified person to do my job. I would like to know my options after the appeal outcome if the company's position does not change. Do I simply resign... Is this constructive dismissal? Do I then look to make a claim? Is constructive dismissal my only option at the end of grievance proceedings?
