Changing family friendly working hours: ask the expert

When I returned to work after my second child I was offered a job that meant a different shift pattern and childcare problems. Then I tore a ligament at work and had to have time off. My boss told me I was being removed from my position because of my sickness and would have to reapply for family friendly hours. Can he do this?

It sounds like your employer is not being very sympathetic to your injury which, considering it happened during working time, is surprising.

I would suggest that you lodge a formal grievance with your employer, using your Company’s grievance procedure or using the statutory procedure (ie start by writing a letter laying down your complaint). It might also be worth talking to ACAS as well since if the grievance does not change the situation in your work place, you might have a case for claiming constructive dismissal or discrimination. ACAS provide a free, independent advise service and will be able to talk through the whole situation with you and advise you on next steps.
