Job advertised as full-time given to part timer

A position recently became available for a full-time post one grade above my current grade. I enquired if a job share would be considered and was told no. I therefore did not apply as I can’t work five days or four very long days. I have now found out that the job has been offered to someone part time – four standard days. This seems unfair as if part time was an option I would have applied. Have I any grounds to complain about this?

Answering your query does require consideration of a number of issues. For instance, what reason was given by your employer when you were advised that a job share would not be considered? Are you already doing a job share now and why did you not ask about part-time working also?

Unfortunately, based on the information provided, I cannot advise that your employer’s conduct amounts to discrimination of any kind in circumstances where you do not appear to have asked to undertake the role part time and/or where no information has been provided about the successful applicant, including his/her suitability for the role. If you and the successful applicant are both women, it may be sufficient for your employer to simply state that you were not considered for the role because you did not apply for it.
