I am due to return to work soon and I have requested reducing my contract to 24 hours as an assistant manager, but this has be declined for several reasons which are valid according to the legislation and I would like to appeal. I am struggling with what to put down as my reasons for my appeal and they have also not offered me any other options which leaves me in a very difficult situation as my children are in nursery three days a week and I have no other options for childcare. I am currently on maternity leave and due to start back in November. My intention is to put in a request for flexible (and part-time) working. In my contract it states that my work must include some weekends. I have usually worked about 3 in 4 Saturdays and 1 to 2 in 4 Sundays before I became pregnant. Being a single mum I have been searching for childcare and have been unable to find any childminders/nurseries in my area that will mind my child on weekends. I have looked at 20 plus childminders/nurseries, calling all the childminders and asking them direct. There are no other childcare solutions for me (eg family/friends). In the circumstances can my employer refuse a request from me NOT to work any weekend shifts? It is not as though I can 'compromise' by even doing fewer weekends, as there is no childcare provision at all for weekends in my area. Would I be able to force them in effect to not make me work weekends if I can prove there is no alternative solution for me? Many thanks.…

I am unhappy about childcare in my nursery. My two year old appears scared of staff. They are unfriendly to me, never say hello and ignore my son when he comes in. I also find him abandoned in a corner on his own when I pick him up. He had a couple of accidents-bruised nose, scratches and bumbs. He comes home dehydrated and very thirsty - his daily sheet shows he has dry nappies all day long.Once they called me asking me where he was despite him being there! The last incident was when he left the nursery unnoticed and another parent found him outside and brought him back!
The staff informed me about this incident when I came to pick him but played it down. I feel someone hurts him there as he seems terrified of some of the staff, clinging to me and holding tight, which is unusual as he is very sociable and likes company otherwise. Also he is terrified when I
want to change his nappies, screaming and holding his hands in front. He gets happy as soon as he is dressed again. I don't want to cause problems or accuse anyone, but I feel something wrong is going on in the nursery. What can I do?

I have been out of work for three years and before that I worked in a food shop. I really want to get back to work into something new, but don't know how I'm going to work and learn something new without getting a wage that will pay childcare and bills. I've have been working for a hotel company for four years, doing a morning shift ie 7-3 or evening shift ie 3-11 or 5-11. Last year when I became pregnant, the HR manager was made redundant. My manager had no experience on pregnant employee issues so my risk assessment wasn't done and my hours were cut down. From a 39-hour contract, I was given 15-22 hours. Due to heavy lifting or moving of furniture, I injured my back so I took early maternity leave. During my leave, I found out about the procedures which were not followed while I was pregnant. I filed a case before an employment tribunal, but was rejected as it was not in the three-month claim period.
When I was due back at work, I put a flexible working request to work a particular shift ie morning only & weekend off so that we can work out childcare arrangements between my husband and myself. This was refused due to business needs. I can either to full or reduced part time hours. I do not believe there is a good business reason. My manager gives me all the difficult shifts, for instance evenings one day and early mornings the next. When I have objected, my manager says he has heard how much I like going to the employment tribunal and making a fool of myself so I should do that. Online I read that employees should have an 11-hour break between each shift, but my manager says that the hotel policy does not acknowledge this. I've found out that employees in different departments have been given flexiblity as they have young babies. Also, in my department, they have one part-time morning supervisor. Recently my husband has changed his job and he gets weekends off so I asked my manager not to give me weekends off as my husband can look after my baby, but he won't listen and keeps giving me the weekend off. Can I ask only for evening shifts? Also the hotel has just been bought by a different company so can I make another flexible working request?
