I have worked for a car hire company for the last two and a half years. In December 2009 I had my baby and I'm planning on returning to work at the end of August (w/c -31st). I've had a meeting and given a letter asking to go part time, instead of full time. However I have recieved a letter back saying I have to have another meeting to explain why I am needing to work part time, to demonstrate why no one can look after my child whilst I'm at work, etc. Before having my son I worked six days a week for nine hours a day, I'm not a manager and no one else did this so I don't understand why they won't allow it, and whilst I have been on maternity leave they have hired three new part time members of staff. I returned to work four weeks ago after taking 10 months maternity leave. It is a long story so I will try and shorten it, while on maternity leave I had a new manager and my old manager moved to another department. During my maternity leave there were changes to my position, it basically meant my role was being split up. I had very little contact with them during maternity leave and was not informed of any changes, most of the information came third hand. I really wanted to to retain the same or similar position which they were aware of but wanted to work four days a week. I was delighted when they said this was possible. I met up with my new and old manager who informed me that things had changed but there were lots of opportunities for someone with my skills and experience. I was excited about returning to work however I then found out that my new manager, who I had only met properly once was leaving. I went into work on my first day back and had a brief meeting with the new head of department who explained he was getting to grips with his new department and not making any important decisions. It then transpired a few days later that I was to be demoted because I could only work four days a week. This decision was made by a manager who had never worked with me. I complained to the new head of department, who was taken aback, I followed this up with an email and the following week he said it would be okay and they would come up with a job description. That was three weeks ago and I am still waiting, I chased them last week and he said they had a meeting but he needed to make changes to the job description. This has caused much stress as I really enjoyed my previous role, I am pretty sure the new job description will still be a demotion, please can someone advise me what rights I now have and how I should handle the situation? I worked for a company from Feb 2005-Oct 2009 for 18 and a half hours a week to qualify for family tax credit, with 10 days holiday a year and I never got paid for bank holidays. My working days were Tuesday 5 and a half hours, Weds and Thurs, full days at 7 hours each. The company officially went bust in March 2010 and the two other staff members also long term, are claiming redundancy. I am in the process of re-sending paperwork to claim from the insolvency for unpaid salary that I am still owed over the whole period due to miss calculations from my employer. Am I also able to claim back holiday money as I now find that legally I should have been entitled to more days off plus the bank hols although part-time? I started on £6.00 salary that went up to £7.00 a year later then to £8.00 in July 2009. I would really appreciate it if you could advice me as to what I should do next with regards my entitlements. I work three days part-time but I am being emailed and called outside my agreed work hours despite repeatedly notifying my colleagues of the days that I work. Furthermore, I work in the evenings and at weekends to keep up with my busy workload. I’ve raised this with my manager but she has told me to keep going and that we will later review my position. I am coming to the end of my maternity leave and have been trying to sort out childcare for my return to work in August. Five weeks ago I contacted my employer, first by phone then email, to request a slight movement in my hours (I worked 18 hours a week) to help me with my childcare. He suggested there should be no problem and forwarded it to my supervisor to look at. Two weeks ago I phoned to ask if anything had been looked at as my childminder had contacted me to say she was getting booked up. He said he'd contact my supervisor and I am still waiting to hear, despite me having told him I'd like to sort out my hours as soon as possible. There has been minimal contact from work while I've been off and I have a feeling they don't want me back. I feel it is unfair as I have tried to sort this out in plenty of time so that everyone can arrange things accordingly.
