Unfair dismissal change 'could lead to increase in employment tribunal claims'
Over half of employers think changes to legislation around unfair dismissals will lead to more rather than fewer employment tribunal claims, according to a survey by XpertHR.
The survey showed 51% of the 258 employers polled thought the Government's decision to lengthen the period of service required before an employee can claim unfair dismissal from one year to two would result in more claims as employees claiming under other headings, such as discrimination.
When the change was brought in in April, the Government claimed the move would reduce claims by between 3 and 5 %.
The survey also shows only 22% of employers thought the number of claims would fall as a result of the change. Nevertheless, figures from the Ministry of Justice covering the year up to March before the change was brought in show a 15% drop in claims from the year before, suggesting a downward trend has already begun.
