Do I accrue annual leave whilst on maternity leave and what happens about public holidays? My new holiday year has begun whilst on maternity leave, but when I return to work I will be part-time. How do I work out what holiday I am entitled to?
You will accrue your holidays at full time rate until you return and thereafter the remaining part of the year would be pro-rata-ed if you return part time.
In relation to bank holidays – this is not straightforward and it may depend on what your contract says – for example, if your entitlement is 20 days plus bank holidays – then you should accrue these whilst on maternity leave.
The general rule is that you accrue all contractual and statutory holiday pay and so it is certainly arguable that you should accrue bank holiday.
