Can I take a second job in the unpaid part of SMP?
I am currently on maternity leave and my SMP has ended – I’m on the last three months of no pay. Can I get a part time remote job without it affecting my leave/previous maternity pay? I would intend to maintain a few hours a week when I return to my job – if that was possible.
In the circumstances you describe, the only real consideration will be whether or not your existing contract of employment permits you to do work for another business at all.
Many full-time employment contracts do not permit it and some require the employee to seek permission before taking on a second job. It is important that an employee carefully checks the contract of employment with the current employer before taking on a second role.
Subject to the above point, as SMP has finished in this scenario, there should be no other adverse implications in relation to being on maternity leave or for the statutory maternity pay already received from the current employer.
