Do I have to take my annual leave before my baby arrives?

Our company is in the process of being bought and will likely to all be finalised in January.  I am due to go off on maternity leave in early May and have been told I have to take five weeks of accrued leave before that. I wanted to delay starting my maternity leave until later and use my holiday in the early days so I could have longer on leave. Are they correct that I have to take all the holiday before my baby comes?

Annual Leave

 

If your holiday runs from April – April and you haven’t used any of your leave for the year then you will need to use it up before the baby comes.

You have to start your maternity leave the day the baby comes – due to Government legalities. You can’t use holiday for the first month when the baby comes then start maternity leave.

Although it seems like a long time off before the baby comes (this leave really should have been used throughout the year, so there wasn’t such a big chunk to use) you will be given a new allowance for April 2020- April 2021 so you will have another 5.5 weeks to use at the end of your maternity leave (that would have accrued throughout the year, while on maternity leave).
