Does a second job change my right to SMP? Ask the expert

I am 15 weeks pregnant and work a full time job. I also have a second teaching job that is only three hours one night a week. I would like to take full maternity from my full time job (Statutory Maternity Pay) but I would also like to keep doing my three hours for one evening a week as I feel I could manage this. Would this influence my maternity pay from my full time job?

If you satisfy the following two conditions then you can still work your part time job during your maternity leave without it affecting your SMP from your full time employer:

  • 1.    You are employed by both employers during the qualifying week (being the 15th week before the week in which the baby is due);
  • 2.    Your part time employer is not liable to pay SMP e.g. because you do not earn over £97 per week in the part time job.

It is also worth noting that you are not entitled to return to any work during the two-week period following childbirth.  This is known as your compulsory maternity leave.

    Editor: Can you provide more information? What point are you at in your maternity leave? Is your concern that you will lose SMP because you have taken a job during maternity leave?
