I am due to return back to work in July. I have accrued 17 days holiday in this six-month period. When I return I will be in a different role in the company. My previous role wasn’t suitable with a baby. I will be on a lower hourly rate and working less hours a day. My question is – in regards to the 17 days I have accrued on maternity leave am I right to think they should be paid at my previous salary level ie the higher rate?
For holiday that is accrued during maternity leave, this should be taken before the employee returns to work or as part of a return to work.
If this holiday is used before the return to work then it should be before the new role starts. The holiday will stop any maternity pay and the days for the holiday will be paid at the rate of the role that she was doing before maternity leave.
