I have been told my job is at risk of redundancy. There are two people doing the same role. There is one position available which has been given a new title, but is essentially the same job. However, they have posted this vacancy on the internal job board so other people within the company can apply – is this lawful? I believe if you are under threat of redundancy you should have preference over others?
Unfortunately, the company is within its rights to advertise the role internally or even externally, as the process is about ensuring the right person is in the role, and it is acceptable for internal candidates to also apply and be interviewed, even if the role is due to a redundancy situation.
If you are unsuccessful for the role, you should be entitled to redundancy pay as long as you have the correct service.
If you do feel you are being treated unfairly then you can make a complaint to HR.
