What if I take a new job while my partner is on Shared Parental Leave?

I’m currently on maternity leave. I’m sharing the leave with my partner. I’m due to go back later this year and my partner will start the leave then. An amazing job opportunity has come up. If I go for this job, can my partner take my maternity leave over early?  What notice do we both need to give our current employer as we both work for the same place?

It is possible to make a request to vary the dates of the shared parental leave but to do so you will need to request this with your current employer.

You can vary your proposed SPL following the submission of a period of leave notice, provided that you give written notice to vary the leave and make clear what change you are seeking. Any variation must be made at least eight weeks before the variation begins.

A notice to vary booked SPL will count as a further notification. Therefore if you had originally agreed the leave as part of your first notice to book SPL, varying the leave would count as a second notification (some employers only allow a certain number of these).

If you have already used up all your notifications, the employer is under no obligation to agree to vary the leave, but they could still consider the request and decide whether it is reasonably practicable to grant it.
