Employment lawyer Crystal Bolton from Michael Lewin Solicitors discusses your rights if your employment ends during pregnancy or maternity leave in a new video.

She says that if you decide to resign when you are pregnant you will still be entitled to SMP as long as you hand your notice in within the 15 weeks leading up to the birth of your child. Your employment will end when your notice expires and you will lose your maternity leave and benefits.

If you are made redundant during maternity leave you are entitled to be offered a suitable alternative vacancy if there is one.

If you are dismissed during maternity leave your employment your leave will come to an end. If you get SMP this will continue for the statutory maternity pay period.

If you can prove that your company has dismissed you because of your pregnancy, childbirth or maternity leave you may have a claim for automatic unfair dismissal and you should seek further legal advice.
